availible, but then I do a search to see if its availible and it isnt.

intellectual copyright on the name of the website (not necesarily the
domain) and its contents.

The problem is a copyright isn't enough to get the domain back,
according to both register.com and IARegistry.com's Dispute Policy. We
need to have a trademark, not a copyright. I can contact register.com
and see if a copyright would be enough, but I doubt it, even for a
non-profit org. (Technically, we're not a one-man operation... ;P)

It has nothing to do with Mikey. In order for me to have a legitimate
case, I need to have a TM that is in direct conflict with the domain
name, that's all there is to it.
Although, the Dispute Policy also said a Service Mark (SM) was
acceptable. Chris, think AWNews would be eligible for an SM? :)

Well Goob, perhaps. But I'm not entirely sure what an SM is, or if it's
retroactive.
Are you sure you have to meet _all_ three of those requirements you posted?
I really would get a lawyer's advice. There are services out there on the
net where you can get a legal opinion, but it might work out better if you
asked someone local.
They say hindsight is 20/20. But thwack Cyb0r one anyways for me for not
bothering to renew and transfer... ;P
